Cochrane Watersports does NOT ACCEPT ANY LIABILITY for theft or damage to the rental equipment "The Equipment" or any items that become lost while the rental equipment is in your care. Cochrane Watersports does NOT ACCEPT Liability for bodily injury/death resulting from the use of the rental equipment in which you have rented, whether you are on the water, in the water, or out of the water. We also DO NOT ACCEPT ANY LIABILITY for damage you cause to infrastructure, any other motorist, boater, non-motorized or motorized water crafts, structures, water ways, facilities, forestry areas, private lands and, wildlife whether it is a land or water animal, mammal, or any living or non-living species known or unknown, and any items not identified to/by Cochrane Watersports, and its employees, agents, successors, assigns, executors, heirs, or any person known, or unknown to the parties.  We also DO NOT ACCEPT ANY LIABILITY for your personal items left in your vehicle, or items you bring with you while you are in an active Rental Agreement "The Agreement".

Cochrane Watersports does NOT ACCEPT ANY LIABILITY for any acts of nature while you are in a Rental Agreement with us "The Agreement" and further DO NOT  ACCEPT any liability from/for any partner that Cochrane Watersports has agreements with, regardless if there is a written,  or verbal contractual agreement with the partner. In addition, we DO NOT ACCEPT ANY LIABILITY forthwith, and you the Renter are liable to compensate Cochrane Watersports, its insurer, and any partner of Cochrane Watersports, to settle any claim for bodily injury/death to the general public at large, including your guests, family, animals, and for any lost equipment, damage, malfunction, submersion, leaks, failure of parts, accessories, structural integrity, paint, theft, punctures, or controls that are a part of, or attached to the Rental Equipment "The Equipment".  The renter will be held liable for any past or future payments to repair the Rental Equipment “The Equipment” to its original state or, if new equipment needs to be purchased in the event of a total loss, the renter will be liable to pay for such equipment at their expense. You the renter, by entering into a rental agreement "The Agreement" give Cochrane Watersports permission to charge your credit card, bank account, and any future credit cards or bank accounts for the cost to replace any equipment that is damaged, lost or stolen while in your care, and while in an active rental agreement, and after it has expired. You the renter agree that Cochrane Watersports has the right to refuse a rental in the event that there is a weather situation that would pose a risk to the renter, or their guests. Cochrane Watersports has the right to refuse a rental to any person it deems is impaired by any substance which may impair the ability of the renter to operate the equipment properly/safely. Cochrane Watersports, its owners, employees, agents, heirs, executers, administrators, assigns, successors, or any person known or not known to the company hereby makes you aware, and you understand that by entering into a Rental Agreement "The Agreement " you are accepting all responsibilities and liabilities for ALL actions listed above, whether actual or implied. IT IS FURTHER UNDERSTOOD, AND YOU AGREE TO FOREVER DISCHARGE, ABANDON ANY POTENTIAL OR ACTUAL CLAIMS, DEMANDS, DEMANDS FOR DAMAGES OF ANY KIND, OR RELIEF SOUGHT, REGARDING ANY ACTIONS WHETHER ACTUAL OR IMPLIED when dealing with Cochrane Watersports. By signing our Rental Agreement form, and initialing the boxes as a secondary acknowledgement, YOU AGREE to release, discharge, and forever hold harmless Cochrane Watersports, the owners, employees, agents, heirs, executors, administrators, assigns, successors, Insurance companies that are insuring Cochrane Watersports, Brokers, Underwriters, Partners,  or any person or entity that is known, or not known to Cochrane Watersports from ANY CLAIMS both past, present, and future.
